Right of Way Acquisition Procedures Manual
The Local Public Agency (LPA) Right of Way Acquisition Manual, designed by the North Dakota Department of Transportation (NDDOT), is a guide to right of way acquisition procedures which must be observed by LPA
representatives in the acquisition of road right of way. Information and procedures discussed in this manual pertain to all North Dakota road projects that involve the participation of federal funding, regardless whether federal monies are used in the actual project right of way costs. If federal funds are involved at any project stage, Right of Way Acquisition Procedures for LPA Federal Aid Projects must be observed to ensure compliance with state and federal regulations.
If you have questions concerning LPA guidelines, you should call the Environmental Transportation Services Division - Right of Way Section, Local Government Division, or the Planning and Programming Division. If necessary, a NDDOT representative can assist the LPA in explaining appropriate procedures before or during the acquisition process.
