ALCOHOL-RELATED LEGISLATION

HB 1082 - Makes the selling, purchasing, or possessing of an alcohol without liquid (AWOL) device a Class B misdemeanor, punishable by a maximum penalty of 30 days imprisonment, a fine of $1,000, or both.

HB 1346 -Allows the removal of a partially-consumed bottle of wine from a restaurant provided the licensee recorks the bottle, seals the bottle with a seal that must be made conspicuously inoperative to reopen the bottle, and places the receipt of sale with the bottle.

SB 2204 - Gives a person under 21 years of age immunity from prosecution for minor- in- possession/consumption if they report another individual under 21 in need of medical assistance due to alcohol consumption.

SB 2329 - Requires the court to sentence a violator convicted of MIP/MIC to drug and alcohol education.

DRIVER LICENSE

HB 1069 - Changes the language a peace officer is required to give to a driver who refuses an alcohol test and explains that a refusal will result in a revocation for up to four years of the person’s driving privileges.

OFF-HIGHWAY VEHICLES (ATV)

HB 1445 - Requires off-highway vehicles that are operated on a roadway to be equipped with: mirror, horn, speedometer, odometer, brake light, lighted headlamp, and a motor of at least 350 cubic centimeters.

Allows the operation of an off-highway vehicle on a paved highway designated and posted at a speed not exceeding 55 MPH. A licensed driver over 16 years of age may operate a registered Class III off-highway vehicle on a paved highway designated and posted at a speed not exceeding 65 MPH.

HB 1476 - Cities may allow, by ordinance, the use of golf carts on city streets. However, the ordinance may not allow golf carts on federal, state, or county highways in the city, except for perpendicular crossing of these highways. Operation is only allowed during daylight hours, and only to and from the operator’s place of residence and a golf course.
